1. Introduction

Welcome to OctoTip ("we," "us," or "our"). By accessing or using our websites, mobile applications, and digital tipping services (collectively, the "Services"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Services Description

OctoTip provides a digital platform that facilitates cashless tipping. Our Services allow users ("Tippers") to send voluntary monetary tips to service providers or recipients ("Receivers") via QR codes or direct links. We act as a technical intermediary and are not a bank or financial institution.

3. Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. By using OctoTip, you represent and warrant that you meet these requirements.

4. User Accounts

• Registration: You may need to register an account to receive tips. You agree to provide accurate, current, and complete information during the registration process.
• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

5. Payments and Fees

• Tipping: All tips are voluntary. Tippers choose the amount they wish to send.
• Processing Fees: We may deduct a transaction fee or platform fee from the tipped amount before it reaches the Receiver, or charge a convenience fee to the Tipper. Applicable fees will be clearly displayed prior to completing a transaction.
• Payouts: Funds collected by Receivers will be transferred to their designated bank accounts or payment methods according to our payout schedule. Delays may occur due to banking clearing times.
• Refunds: Tips are generally non-refundable once processed. If a technical error occurs, please contact support.

6. Acceptable Use

You agree not to use OctoTip for any unlawful or prohibited purpose, including but not limited to:

• Money laundering, financing of terrorism, or fraud.
• Selling prohibited goods or services.
• Harassing, abusing, or harming others.
• Interfering with the proper operation of the Services.

7. Intellectual Property

All content, trademarks, logos, and technology associated with OctoTip are the property of OctoTip or its licensors. You are granted a limited, non-exclusive, non-transferable license to accept and use the Services for personal or internal business purposes.

8. Limitation of Liability

To the fullest extent permitted by law, OctoTip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law principles.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
